What is the California Environmental Quality Act (CEQA)?
The California Environmental Quality Act (CEQA) is a California statute that requires government agencies to analyze, consider, and make available to the public, information about potential environmental impacts that may result from proposed discretionary development projects. This analysis is accomplished through the creation of an initial study analyzing potential impacts from the project proposed, and from this analysis, subsequent preparation of either a negative or mitigated negative declaration (statements of either “no environmental impact” or “no impact with mitigation in place”) or an environmental impact report (significant impact(s) likely - detailed environmental analysis required).

Does My Project Require Review Under CEQA?
CEQA requires analysis of most discretionary projects. A discretionary project is any action where a public agency (such as the City of Dana Point) exercises judgment in deciding whether to approve a project. Projects that require an agency to merely determine conformance with local standards in order to issue a permit or other entitlement are called “ministerial” projects and are generally exempt from analysis. That stated, certain discretionary projects are also exempt from analysis, and are listed in Article 18 (Statutory Exemptions) (PDF) and Article 19 (Categorical Exemptions) (PDF) of the CEQA Statute.
